General Terms and Conditions of Sale

The advisory commission for commercial practices recommends that service providers in the paragliding industry establish general terms and conditions of sale tailored to their specific needs, based on the model provided below:

  1. Conclusion of the Contract
    Any booking or purchase of paragliding services implies full acceptance of these general terms and conditions of sale, which are supplemented or modified by any specific terms, overriding any clauses to the contrary that may appear in order forms, purchase orders, or other commercial documents.

  2. Pricing
    Services are charged at the rates in effect on the date the booking is made. The general rate list is attached to these conditions. Prices may be revised with a 30-day prior notice.

  3. Delivery
    Services are delivered either by direct provision of the service to the customer or through notification of availability. If a third party (e.g., a guide or transport service) is involved, the service will be delivered at the vendor’s premises or at another designated location.
    Customers must verify the service immediately upon delivery.
    In case of issues such as damage, defects, or non-compliance with the service, the customer must raise clear and precise reservations within three days of the delivery date, notifying the vendor or the service provider in writing. The customer must provide proof of the issues.

  4. Delivery Times
    Delivery times are indicated based on service availability.
    Except in cases of force majeure (such as war, riots, fire, total or partial strikes), if delivery is delayed by more than [specific time] after the indicative delivery date, the customer may cancel the booking without claiming any compensation.

  5. Returns
    Any return of service or product must be agreed upon by both the vendor and the customer.

  6. Warranty
    The vendor will take the greatest care in executing the order and ensuring the quality of the services. In case of any acknowledged defect by the vendor, the vendor’s obligation will be limited to replacing or refunding the defective service or product, without further compensation. The warranty excludes defects or damages resulting from improper storage, handling, transportation, or use that does not comply with the nature, specifications, or intended use of the service or equipment.

  7. Payment
    Unless otherwise specified, invoices are payable within [specific time] from the delivery date. If payment is delayed, the vendor may suspend all current bookings. Any unpaid amounts after the due date will automatically accrue late payment penalties equal to one and a half times the legal interest rate. These penalties are payable upon request by the vendor.
    No discount will be granted for early payment. A discount of [percentage] will be given for immediate payment.

  8. Termination Clause
    In the event of non-payment, forty-eight hours after a failed formal notice, the vendor may terminate the contract and demand the return of any products or services provided without prejudice to any other claims for damages. Any remaining amounts for other services will become immediately due if the vendor does not opt for the cancellation of corresponding bookings.

  9. Retention of Title
    The services provided remain the property of the vendor until full payment is made. However, the risks related to the services are transferred to the customer or transport provider once the service is physically delivered.

  10. Jurisdiction
    These conditions replace all previous terms. Any disputes regarding these terms will be under the jurisdiction of the relevant commercial court in [city].
